A motorist claims another driver failed to stop at the intersection of Cypress Street and 12th Street in Highland, causing a collision.
Audrey Kasmarzik filed a complaint July 12 in the Madison County Circuit Court against Ralph Kampwerth in the Madison County Circuit Court, alleging negligence.
According to Kasmarzik’s complaint, she was driving her 2016 Ford Escape on Cypress Street at the intersection of 12th Street in Highland on Oct. 10, 2019. She claims Kampwerth was traveling on 12th Street and approaching the intersection. He had “a stop sign facing his direction of travel” but allegedly failed to stop and collided into the side of the plaintiff’s vehicle.
Kasmarzik alleges she suffered injuries to “various parts of her body” including her knee, shin, elbow, shoulder, back and neck, resulting in medical treatment expenses.
She alleges Kampwerth was negligent for failing to keep a proper lookout, speeding and driving while distracted. She also alleges Kampwerth failed to yield the right of way and should have warned or tried to maneuver to avoid the crash.
Kasmarzik seeks compensation of more than $50,000 and all other just relief.
