A mother is suing the managers of a Cahokia Heights apartment building after her son allegedly fell through a bathroom floor and suffered injuries.
Linda Eiland, individually and as mother and next friend of Cameron Bedford, filed the complaint in the St. Clair Circuit Court against Chicago Title Land Trust Co., successor to American National Bank & Trust, Successor Trustee of Illinois Land Trust #45305, doing business as Greystone Apartments, and Ross Financial Services Inc.
According to the complaint, Eiland claims she was a tenant in Unit B at Greystone Apartments located at 319 Greystone Drive in Cahokia Heights with her son, Bedford. She alleges she had previously given notice to the defendants that the floor in the upstairs bathroom was in a state of disrepair.
On Feb. 10, Bedford was allegedly in the upstairs bathroom when he fell into a deteriorated portion of the floor and became lodged. As a result, Eiland claims Bedford suffered injuries to “various muscles, ligaments, membranes, nerves, blood vessels and tissues of his body.”
Ross Financial allegedly attempted to repair the bathroom, but “repairs were not completed in a workmanlike manner,” according to the complaint.
“At all relevant times alleged herein, it was the duty of defendants to keep the subject premises in habitable condition, to exercise reasonable and ordinary care in maintaining
the subject premises and to remediate any dangerous conditions of which defendants were (or should have been) aware,” the suit states.
Eiland seeks a judgment of more than $50,000, plus legal costs.
