A woman is suing a Troy couple after their dog allegedly attacked her without provocation.
Plaintiff Susanne Tomlinson filed the lawsuit in the Madison County Circuit Court against defendants Jason Simmons and Kristi Simmons, citing negligence in violation of the state’s Animal Control Act.
According to the lawsuit, the defendants were walking their dog without a leash on a street in Troy on April 27. The suit states that the dog suddenly and without warning attacked Tomlinson, who was nearby.
Tomlinson claims the incident caused her to endure pain, suffering, disfigurement and emotional trauma. She also claims her injuries may be permanent and that she has incurred medical expenses and will continue to require the services of medical staff to recover.
The lawsuit states that under the Illinois Control Act, the owner of the dog is liable for injuries caused by the animal.
The plaintiff is seeking damages in excess of $50,000, plus attorney fees and any other relief the court deems proper.
