A dump truck driver claims another motorist attempted to pass him as he was making a left turn, causing the dump truck to flip on its side.
Bruce Layher filed a lawsuit on Dec. 10 in the Madison County Circuit Court against Larry D. Nix, alleging personal injury and property damage.
According to the lawsuit, Layher was driving a dump truck south on Route 159 in Moro Township on March 23, 2020. Nix was driving a 2020 Jeep Cherokee directly behind Layher. The plaintiff claims he was preparing to make a left-hand turn onto Maple Drive when Nix attempted to pass the dump truck, collided with the vehicle and caused it to flip on its side.
Layher alleges Nix attempted an improper pass on the left, failed to keep a proper lookout for other traffic, failed to slow down, stop or swerve to avoid a collision and drove in a manner as to strike another vehicle.
Layher claims she was caused to suffer severe, permanent and disabling injuries, past and future physical pain and expenditure of large sums of money for hospital and medical treatment.
Layher seeks a judgment in excess of $50,000, pre and post-judgment interest and cost of suit.
