A barge worker claims he suffered injuries when the barge was struck by another vessel and was not given proper maintenance and cure under general maritime law.
Donald Dailey, Jr., filed a complaint April 6 in the U.S. District Court for the Southern District of Illinois against Commercial Barge Line Company, Commercial Barge Line Company ACBL Transportation Services LLC, ACBL Transportation Services LLC, American Commercial Barge Line Company ACBL Transportation Services LLC and American Commercial Barge Line LLC, alleging breach of statutory duties.
Dailey alleges in his complaint, Dailey was working on a loaded barge on April 19, 2018. The barge was next to a partially loaded barge, and Dailey had to climb to the lower barge to secure the barge in two. He claims that as he crossed over with one had on the deck fitting, the defendants’ M/V Fort Defiance vessel bumped into the barges and caused him to lose his grip, slip and fall onto his right shoulder.
Dailey alleges he suffered a tear and detachment of his biceps and required surgery, physical therapy and other medical treatments.
He also claims the defendants failed to provide him with adequate maintenance and cure for his injuries.
Dailey seeks monetary and all other just relief.
