A shopper is suing the Carlinville Wal-Mart after she allegedly became distracted and slipped and fell on the yellow painted lines in the parking lot.
Deborah Huff filed the complaint Sept. 15 in the St. Clair County Circuit Court against Wal-Mart Inc., Travis Miller and Morgan’s Striping Service Inc. The suit states that Miller owns, operates, manages or maintains the Wal-Mart store where the alleged incident occurred.
According to the complaint, Huff claims she was walking in the parking lot of the Carlinville Wal-Mart of Sept. 19, 2018, when she allegedly slipped and fell on the yellow painted lines “that had no aggregate or grit.”
As a result, she claims she suffered injuries to her left knee, endured pain and suffering, mental anguish and loss of a normal life.
Huff alleges the lines presented a dangerous condition and that the defendants negligently distracted her, failed to inspect the parking lot, failed to remedy the dangerous condition, and failed to warn of the condition. She also alleges Morgan’s Striping Service negligently lined the parking spaces in accordance with industry standards and lined the parking lot without aggregate or grit within the paint.
Huff seeks a judgment in her favor in excess of $50,000.
