A patient is suing a Belleville chiropractic clinic after she allegedly tripped and fell while walking near the front door.
Alice Williams filed suit June 10 in St. Clair County Circuit Court against Kaesberg Chiropractic Clinic of Belleville.
Williams claims she was lawfully on the defendant’s premises on Dec. 5, 2018, when she allegedly tripped and fell near the front door.
The plaintiff claims she was attempting to enter the facility when she fell because of a dangerous condition, according to the complaint.
“Namely, the front door does not have a platform and/or level walkway that extends the entire length of said door when opened, requiring customers to navigate a change in elevation in addition to opening the front door,” the suit states.
The alleged “dangerous condition” presented “an unreasonable risk of harm to people lawfully on the premises.”
The defendant is accused of violating the Premises Liability Act.
Kaesberg Chiropractic Clinic is also accused of negligence for allegedly failing to properly inspect the premises, failing to to extend a level walkway under the length of the front door, and failing to warn.
As a result, Williams claims she sustained bodily injuries to her body, some of which may be permanent, including injuries to her neck, left shoulder, back, abdomen, and left side.
She also claims she has incurred medical expenses and will continue to do so in the future.
The plaintiff is seeking more than $50,000 in damages.
